PARKS AND RECREATION REFUND POLICY


The City of Tyler Parks and Recreation Department will consider refunds for programs and rentals in accordance with the following policy. All refund requests must be in writing and may take a minimum of four (4) to six (6) weeks to process.


RENTAL OF INDOOR FACILITIES

Indoor Facilities include (but not limited to):
Glass Recreation Center, Harvey Convention Center, Rose Garden Center and Tyler Senior Center
1. To ensure a reservation the LESSEE is required to pay a rental deposit in the amount of twenty-five percent (25%) of the facility rental for each day reserved (in some facilities only twenty-five (25%) of the total rental fee shall be collected).
- This amount is non-refundable.


2. A damage/cleaning deposit shall be collected pursuant to the Rental Contract and City Code.
- Applicable damage deposits shall be refunded after the event if the premises are clean, in good order and all business transactions have been satisfactorily completed with the CITY.


3. LESSEE may cancel without any obligation if the CITY is notified in writing by the date which is thirty (30) days prior to the event date, and may receive a refund of monies paid, excluding the twenty-five percent (25%) rental deposit, which amount is non-refundable.


- All consideration paid to the CITY shall be forfeited to the CITY whenever LESSEE fails to give said notice.


PROGRAMS


1. Participants are not considered registered for a program until registration fees have been paid in full.


2. The City of Tyler Parks and Recreation Department reserves the right to cancel programs due to insufficient registration and will issue a full refund to program registrants.


3. Full refunds will be granted if a class or program is canceled due to insufficient registration or registration limits are reached by the City of Tyler Parks and Recreation Department.


4. Full refunds will be issued if the registrant cancels seven (7) days prior to a class or program. If cancellation notice or payment is received after the seven (7) day period, no refund will be issued.


SPECIAL EVENT PERMIT


1. LESSEE may cancel without any obligation if the CITY is notified in writing by the date which is five (5) days prior to the event date, and may receive a full refund of monies paid. If cancellation notice or payment is received after the five (5) day period, no refund will be issued.


2. Damage deposit, if applicable, shall be refunded after the event if the premises are clean, in good order and all business transactions have been satisfactorily completed with the FACILITY.


3. In the event complaints are received, the Tyler Police Department reserves the right to shut down ANY event. No refund will be issued if event is shut down. Denial or suspension of this special event permit may be appealed pursuant to Tyler City Code Ch. 8, Art. III, Section 8-43 and see also City Code Chapter I, Article IV.


4. All consideration paid to the CITY shall be forfeited to the CITY whenever LESSEE fails to give said notice.


ATHLETIC LEAGUES


1. Full refunds will be issued if a team registrant cancels ten (10) days prior to the beginning of a league season, except that no refunds will be given after the season's game schedule has been completed.


2. If a registrant has to cancel due to extenuating circumstances then a refund request will be evaluated by the Parks and Recreation Department.


3. If a refund is granted a twenty-five dollar ($25) processing fee will be deducted from the fees collected.
